What is a product?

A product contains a design defect if the product doesn’t perform as safely as an ordinary consumer would expect.  For example, without clear misuse people don’t expect their faucet to break or their sedan to roll over.  Faucets can be made of metal so they won’t break, and cars can be designed not to roll with everyday use.  We could give hundreds of other examples.

A product may be defective if the manufacturer didn’t give adequate warnings about the product.  For example, if a ladder collapses when someone is using it, the person weighed 250 pounds, the ladder was only safe for someone under 200 pounds, and the ladder manufacturer didn’t warn consumers of the weight restriction, there was a failure to warn.
